DESCRIPTION
The Kyoto Protocol must face the hard task of accommodating different systems of international law: the general regime and the individual regime (self contained or autonomous) of the European Union. This research project sets itself three objectives.
The first is to conduct an in-depth analysis of the international legal regime of the Kyoto Protocol to identify how compliance is being enforced and any legislative vacuums.
The second is to study the position of the European Community and Member States with regard to its regulatory, administrative and judicial implementation.
The third objective is to scrutinise the interrelation between Protocol obligations and the international trade rules of the WTO; any incompatibility would pose a compliance dilemma to the European Community and Member States as signatories to the Protocol and at the same time full members of the WTO.
